Terms of service and sale

This is a translation provided for convenience. The French version is the authoritative one.

1. Purpose

These terms govern the use of Toscio (the Discord bot, the toscio.com website and the app.toscio.com dashboard), published by Lucas BLANC, EI (sole trader), SIREN 597 132 885, 59 rue de Ponthieu, 75008 Paris, France (“the Publisher”), and the sale of the Premium plan. Using Toscio or subscribing to Premium implies acceptance of these terms.

2. The service

Toscio lets Discord server teams receive and process applications: forms, decisions, role assignment, messages to applicants, dashboard. Toscio is designed for community recruitment (game whitelists, staff, teams, partnerships…). It must not be used for hiring or employment decisions within the meaning of employment law.

3. Accounts and access

The dashboard is used with a Discord account. Only people with the “Manage Server” permission can configure Toscio on a server. You must comply with Discord's Terms of Service and meet the age required by Discord.

4. Rules of use

Toscio must not be used to:

• collect sensitive data (health, religion, political opinions, sexual orientation, biometric data…), identity documents or bank details;
• harass, discriminate against or deceive applicants;
• send illegal content, or circumvent the technical limits of the service.

The Publisher may suspend access in the event of a breach, after a warning except in urgent cases.

5. Free plan and Premium

• Free: 1 open form, 5 questions, “Powered by Toscio” mention.
• Premium (per server): up to 25 open forms and 25 questions, without the Toscio mention.
• Price: €4.99 per month or €49.90 per year, all taxes included (VAT not applicable, art. 293 B of the French General Tax Code). The price displayed at the time of payment prevails (see pricing).
• Payment is processed by Stripe; the Publisher never has access to your bank details.
• Votes on top.gg may give temporary Premium access (12 hours), with no financial consideration.

Purchases are reserved for adults, or for minors with their parents' consent.

6. Term, renewal and cancellation

The subscription renews automatically at each due date (month or year). You can cancel at any time, online, from the Premium page of the dashboard (“Résilier le contrat” / cancel the contract): Premium remains active until the end of the paid period, with no further charge. You can undo the cancellation as long as the period has not ended. For the annual subscription, an email reminds you of the due date before renewal.

7. Right of withdrawal

In accordance with the French Consumer Code (Code de la consommation), you have 14 days from subscribing to withdraw, without having to give a reason. By subscribing, you expressly request that Premium be activated immediately. If you withdraw, you are refunded pro rata for the unused period. To exercise this right: the “Se rétracter du contrat ici” (withdraw from the contract here) button on the Premium page of the dashboard (for 14 days), or an email to contact@toscio.com. An acknowledgement of receipt is sent to you by email, and the refund is made within 14 days to the payment method used.

8. End of Premium

When Premium ends (cancellation, withdrawal or failed payment), no data is deleted: a single form stays open within the limits of the free plan, and the others are paused until Premium returns.

9. Availability and liability

Toscio depends on Discord and on technical providers. The Publisher makes its best efforts to ensure the availability of the service, without being able to guarantee it continuously. Each server remains solely responsible for the questions asked, the decisions made and their compliance. The Publisher's liability is limited to direct and foreseeable damage, except in the case of gross negligence or any contrary legal provision.

10. Personal data

See the Privacy policy. For applications, the Publisher acts as a processor on behalf of servers under the terms of the Appendix below.

11. Mediation

In the event of a dispute, first send a written complaint to contact@toscio.com. If no amicable solution is found, and within one year of that complaint, consumers may refer the matter free of charge to the consumer mediator:

12. Governing law

These terms are governed by French law. Consumers also benefit from the mandatory provisions of the law of their country of residence.

Appendix — Processing of data on behalf of servers (article 28 GDPR)

This appendix applies between the Publisher (processor) and each Discord server that uses Toscio, represented by its administrators (controller).

1. Subject matter and duration: processing the server's applications (receipt, storage, decision, notifications) as long as Toscio is used on the server, then 30 days.
2. Data and data subjects: Discord members who apply; ID, username, avatar, language, join date, answers to questions, decision and reason.
3. Instructions: the Publisher processes the data solely according to the configuration chosen by the server (forms, roles, retention period) and does not use it for any other purpose.
4. Confidentiality and security: limited access, encryption in transit and at rest, measures described in the Privacy policy.
5. Sub-processors: Supabase (database, EU), Vercel (hosting). The server is informed of any change through the Privacy policy.
6. Data subject rights: the /toscio privacy command lets applicants access and delete their data; the Publisher helps the server respond to any other request.
7. Data breach: notification to the server without undue delay, and no later than 72 hours after becoming aware of it.
8. End of processing: deletion of the data 30 days after Toscio is removed from the server, or according to the chosen retention period.
9. Server's commitments: not to request sensitive data or identity documents, to inform applicants and to comply with the GDPR.
